These terms & conditions set out the basis on which you visit and use our website and purchase products.  Please read them carefully as they contain important information.

All rights, including copyright, in this website are either owned by or licensed to Macc Bikes.  Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use is prohibited without the written permission of Macc Bikes.  You may not modify, distribute or re-post anything on this website for any purpose.

2.  Accuracy of content

Macc Bikes has taken every care in the preparation of the content of this website, in particular to ensure that prices quoted are correct at time of publishing and all products have been fairly described.  However, orders will only be accepted if there are no material errors in the description of the products or their prices as advertised on this website and at the discretion of Macc Bikes.  All prices are displayed inclusive of VAT.  Macc Bikes shall not be liable to any person for any loss or damage which may arise from the use of any of the information contained in any of the materials on this website.

3.  Damage to your computer

Macc Bikes makes every effort to ensure that this website is free from viruses or defects.  However, we cannot guarantee that your use of this website or any websites accessible through it will not cause damage to your computer or software.  It is your responsibility to ensure that the right equipment and software is available to use the website and screen out anything that may damage it.  Macc Bikes shall not be liable to any person for any loss or damage which may arise to computer equipment or software as a result of using this website.

4.  Password/account security

You are responsible for maintaining the confidentiality of your password and account and any activities that occur under your account.  Macc Bikes shall not be liable to any person for any loss or damage which may arise as a result of any failure by you to protect your password or account.

5.  Availability

All products are subject to availability.  We will inform you as soon as possible if the products you have ordered are not available.

6.  Ordering errors

You are able to correct errors on your order up to the point at which you click on “submit” on the final page of our ordering process.  Mistakes made after clicking on “submit” cannot be rectified.

7.  Delivery and delivery charges

Delivery will be made to the address specified in your order.  Delivery charges will vary and will be stated for each order when you place your order.

8.  Acknowledgment and acceptance of your order

When you have placed your order, we will notify you by email to confirm acceptance of your order.  At this point the contract for our sale and your purchase of the products shall be made on the terms set out herein and the contract shall be formed at the place from which our acceptance email is sent to you.

9.  Contract cancellation (for parts only)

Please note that you have the right to cancel this contract if you so wish, provided that you exercise such right no later than eight days after the day on which you receive the products ordered.

Please also note that your right to cancel this contract does not apply to the following products, unless they are faulty:

•    Products made to your specification.
•    Perishable products (eg flowers, food).
•    CDs, DVDs, software and audio and video tapes that you have unsealed.
•    Products that cannot be resold for health and hygiene reasons once unsealed (eg body jewellery, personal grooming products).
•    Flat pack products that have been partially or fully assembled.

If you wish to exercise your right to cancel this contract, please follow our ‘Returns Procedure’ (see paragraph 15 below).

10.  Exclusions of liability

All our products are supplied for personal use only and under no circumstances whatsoever will we be liable for any business losses such as loss of data, loss of profits or business interruption.

Our liability to you in connect with any product shall not exceed its total price.

Any disclaimers and exclusions of liability in these terms & conditions shall not apply to any damages arising from death or personal injury caused by the negligence of Macc Bikes or any of its employees or agents or fraud.

If any provisions of these disclaimers and exclusions shall be unlawful, void or for any reason unenforceable then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

There may be legal notices on other areas of this website which relate to your use of this website, all of which will, together with these terms & conditions govern your use of this website.

14.  Law, jurisdiction and language

This website, any content contained herein and any contract brought into being as a result of usage of this website are governed by and construed in accordance with English Law.  The parties to any such contract agree to submit to the exclusive jurisdiction of the courts of England.  All contracts are concluded in English.
